MyGuestStar retains all rights, title, and interest in and to the platform, its design, code, trademarks, and content. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

We may use anonymized and aggregated usage data derived from your use of the Service to improve the platform and generate industry insights, provided such data cannot be used to identify you or your business.

WE DO NOT GUARANTEE SPECIFIC RESULTS FROM THE USE OF THE SERVICE, INCLUDING ANY IMPROVEMENT TO YOUR BUSINESS REPUTATION, REVIEW RATINGS, OR ONLINE VISIBILITY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYGUESTSTAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF MYGUESTSTAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, MYGUESTSTAR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO MYGUESTSTAR IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless MyGuestStar, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit, post, or transmit through the Service.

Either party may terminate this Agreement at any time:

Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. These Terms are governed by the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
